Critically appraise the Commission’s proposals related to the phenomenon of migration instrumentalisation. Does the occurrence of this phenomenon warrant the application of a derogatory asylum regime?

In 2021 the the Commission has proposed firstly a Council Decision based on article 78(3) TFEU and subsequently a proposal for a regulation to tackle situations that entail migration instrumentalisation.  However, civil society and experts have harshly condemned those actions.
